Legislators in the Garden State have filed two bills to regulate gambling ad placement and examine the language used in such ads. The proposed legislation calls for a study on how ad language affects bettors’ behavior and decision-making.

Bill A5562, backed by Assemblyman Clinton Calabrese and Assemblywoman Garnet Hall, passed committee on May 8. It now awaits a second reading in the full Assembly for further debate and potential approval.

On May 12, Senators John McKeon and Renee Burgess introduced companion bill S4366 to a Senate committee. Both bills aim to ban gambling ads near schools and colleges to shield young audiences from exposure.

They also seek to block gambling promotions in media primarily targeting individuals under 21 years old. Lawmakers hope to reduce risky gambling behavior and promote the use of responsible gambling tools.

However, the bills’ language appears broad and focuses mainly on physical ads like signs and billboards. They do not specifically address digital channels, including social media and other online platforms.

In addition to Bill A5562, Assemblyman Clinton Calabrese introduced Bill A5196, which proposes to regulate sweepstakes casinos by treating them as internet gaming operators. This bill would require sweepstakes casino operators to comply with the following: 

  • obtain a license to operate within the state
  • partner with a casino licensee
  • adhere to the same regulations as traditional online casino games operators. 

The legislation aims to bring oversight to sweepstakes casinos, ensuring they meet standards for responsible gaming and consumer protection.

The introduction of these bills reflects growing concerns about the impact of gambling advertisements on consumers, particularly in the context of online slot games and other online casino offerings. 

By regulating the language used in advertisements, lawmakers hope to mitigate the risks associated with problem gambling and ensure that promotional materials do not mislead or exploit consumers.

For operators of online casino games, these legislative efforts may necessitate significant adjustments to marketing strategies and compliance practices. Advertisers may need to revise content, verify ages more strictly, and clarify gambling risks to meet new rules.

As New Jersey continues to address the challenges posed by the expansion of online gambling, these proposed bills represent a proactive approach to safeguarding consumers and promoting responsible gaming practices within the state’s robust gambling industry.
